Terms of service
Last updated: September 18, 2026
IMPORTANT. PLEASE READ CAREFULLY. These Terms contain a binding arbitration agreement, a class action waiver, a mass action waiver and a jury trial waiver (Sections 19 to 24) that affect your legal rights. Disputes will be resolved on an individual basis through final and binding arbitration, except as expressly provided below. You have the right to opt out of arbitration as described in Section 23. By accessing or using our website or purchasing from us, you accept and are bound by these Terms in their entirety.
1. Acceptance of Terms
These Terms of Service ("Terms") govern your access to and use of mp-ma.com, including any related subdomains, checkout pages, landing pages and mobile experiences (together, the "Website"), and any purchase of products or subscription services ("Products") offered through the Website. "MP-MA", "we", "us" and "our" refer to the operator of the Website.
By accessing or using the Website, creating an account, enrolling in a subscription or purchasing any Product, you represent that you are at least eighteen (18) years of age, that you have full legal capacity to enter into a binding agreement, and that you agree to be bound by these Terms in their entirety. If you do not agree, you must not access or use the Website.
1.1 Electronic assent. Where presented, you will be asked to take an affirmative action (such as clicking a clearly labeled button or checking an unchecked box) acknowledging your agreement to these Terms before completing a transaction. Your affirmative action constitutes legally binding electronic consent.
1.2 Changes to these Terms. We may revise these Terms at any time. If changes are material, we will provide reasonable notice by email, by a notice on the Website or both. Your continued use of the Website after changes become effective constitutes acceptance of the revised Terms.
2. Website Use and Access
We grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the Website solely for personal, non-commercial use. We may modify or discontinue any part of the Website, restrict or terminate access, or refuse service to anyone at any time and for any reason. We are not liable if the Website becomes unavailable. Our store is hosted on Shopify, and checkout and subscription billing are provided through third-party platforms.
3. Account Security
If you create an account or use the subscription portal, you must provide accurate and current information. You are responsible for keeping your login details and any portal access links confidential and must notify us at hello@mp-ma.com immediately of any unauthorized access. We may disable accounts for violations of these Terms.
4. Prohibited Uses
You agree not to: violate any applicable law or regulation; scrape, crawl or use automated means to access the Website; interfere with the security or functionality of the Website; upload malicious code; engage in fraudulent or deceptive conduct, including abusive chargebacks or false claims of non-delivery; impersonate any person or entity; attempt unauthorized access to systems or data; infringe any intellectual property or privacy rights; resell Products without our written permission; or collect personal information of other users. We may investigate and pursue violations to the fullest extent permitted by law and may terminate your access without notice.
5. Intellectual Property
All Website content, including text, images, graphics, trademarks, logos, product names, software and design elements, is owned by or licensed to MP-MA. You may not reproduce, distribute, modify or exploit Website content without our prior written consent. No rights are granted except as expressly provided in these Terms.
6. Products, FDA Disclaimer and No Medical Advice
Our Products are dietary supplements. Statements regarding our Products have not been evaluated by the United States Food and Drug Administration. Products are not intended to diagnose, treat, cure or prevent any disease.
All information on the Website, including product descriptions, testimonials, educational materials and other content, is for informational and educational purposes only and is not medical, legal or professional advice. Consult a qualified healthcare professional before beginning any supplement, especially if you are pregnant, nursing, taking medication or have a medical condition. Individual results may vary. Keep Products out of reach of children.
6.1 Reliance disclaimer. Any reliance you place on information presented on or through the Website is strictly at your own risk. We disclaim all liability arising from reliance on Website materials, any interpretation of product descriptions or educational content, and any third-party materials or testimonials appearing on the Website.
7. Electronic Communications
By using the Website, creating an account or making a purchase, you consent to receive electronic communications from us, including order confirmations, shipping notifications, subscription reminders and renewal notices, customer service messages and, if you opted in, marketing communications. You may opt out of marketing emails via the unsubscribe link in those emails. Electronic communications satisfy any legal requirement that such communications be in writing.
8. Privacy, Cookies and Tracking
All information we collect is subject to our Privacy Policy, which is incorporated into these Terms by reference. The Website uses cookies, pixels and similar technologies operated by us and by third parties to run the Website, analyze performance, personalize content and support advertising. See the Privacy Policy for details and choices.
9. Orders, Payments and Billing
9.1 Orders are offers. An order you submit is an offer to purchase Products. All orders are subject to our acceptance. We may refuse or cancel any order, including for suspected fraud, pricing or listing errors, or product unavailability. If we cancel an order after payment, we will refund it. Prices are in U.S. dollars and may change without notice; the price shown at checkout applies to your order.
9.2 Payment authorization. By providing a payment method, you represent that you are authorized to use it and that the payment details are accurate and current. You authorize us and our payment processors to charge your payment method for Products purchased, subscription renewals, optional add-ons such as shipping insurance, applicable taxes and any other disclosed fees. If a payment is declined, we may suspend or cancel your order. You are responsible for any bank or card fees. If a charge is reversed and the reversal was not justified, we may invoice you directly and seek payment by another method.
9.3 Account updater. Our payment processor may receive updated card details (such as a new card number or expiration date) from your card issuer and update your stored payment method accordingly. If you do not want this, remove your stored payment method, cancel your subscription, or contact your card issuer.
9.4 Third-party payment processors. Payments are processed by third-party providers. Your use of those providers is subject to their terms and privacy policies. We are not responsible for processor errors or outages.
9.5 Promotions and discount codes. Discount codes, free gifts and promotional offers (including scratch-card or pop-up promotions) are valid only as stated in the offer, may be limited to one per customer or household, cannot be combined unless stated, have no cash value and may be withdrawn or changed at any time. Free gifts are included only with the orders stated in the offer and must be returned together with the qualifying order if that order is refunded. We may cancel orders or void promotions where we reasonably suspect abuse.
10. Shipping, Title and Risk of Loss
We ship to addresses in the United States only, as described in our Shipping Policy. You must provide a complete and accurate shipping address and, where requested, a phone number. We are not responsible for delays or non-delivery caused by an incorrect or incomplete address you provided. Email hello@mp-ma.com immediately for address changes; we cannot guarantee changes after an order has been submitted.
Unless otherwise required by law, title and risk of loss pass to you when we hand the order to the carrier. Shipping and delivery dates are estimates only and are not guaranteed.
10.1 Shipping insurance. At checkout you may add optional shipping insurance. Insured orders that are damaged, lost or stolen in transit are replaced free of charge under the conditions in our Shipping Policy. For orders without shipping insurance we will assist with a carrier claim, but we cannot guarantee a replacement or refund for transit loss or damage.
11. Delivery Confirmation
Carrier delivery confirmation (including tracking that shows "delivered" to the address you provided) is deemed conclusive proof of delivery, even without a signature. You agree that such confirmation is sufficient evidence of delivery for the purpose of resolving disputes, including chargebacks and claims of non-delivery.
12. Returns and Refunds
Our 90-day money-back guarantee and all other return and refund terms are set out in our Refund Policy, which is incorporated into these Terms. Except as stated in the Refund Policy, all sales are final. Refunds are issued to the original payment method; bank posting times vary. Shipping insurance is non-refundable once the order has shipped.
13. Subscriptions, Automatic Renewal and Cancellation
13.1 Enrollment. The Website offers subscription options that deliver Products automatically at the interval you select at checkout (for example every 4, 12 or 24 weeks). If you enroll, you agree that your subscription involves recurring payment obligations and you authorize us to charge your payment method automatically at the selected interval until you cancel.
13.2 Disclosure and consent. Before you complete a subscription purchase, we show, next to the request for your consent, that your subscription renews automatically and you will be charged on a recurring basis unless you cancel; the length of each renewal period; the amount charged per renewal period and how often; how to cancel (online through the customer portal or by email); and our contact email. You must take an affirmative action to confirm the recurring charges before the purchase is completed. We do not use pre-checked boxes to obtain this consent.
13.3 Automatic renewal and confirmation. UNLESS YOU CANCEL IN ACCORDANCE WITH THESE TERMS, YOUR SUBSCRIPTION WILL AUTOMATICALLY RENEW AT THE SAME INTERVAL AND AT THE THEN-CURRENT PRICE FOR YOUR PLAN. IF THE PRICE CHANGES, WE WILL GIVE YOU ADVANCE NOTICE AS REQUIRED BY LAW. After enrollment we send an order confirmation to the email address you provided with a summary of the renewal terms, the amount and frequency, how to cancel and a link to the customer portal. Keep it for your records. If you do not receive it within 24 hours, email hello@mp-ma.com.
13.4 How to cancel. No unreasonable barriers. You may pause, skip or cancel at any time through either of the following methods. To avoid being charged for the next cycle, cancel at least twenty-four (24) hours before your next scheduled billing date.
- Online (easiest): open the customer portal at subscriptions.mp-ma.com and follow the clearly labeled cancellation steps. No phone call required.
- Email: send a cancellation request to hello@mp-ma.com. We confirm within one (1) business day.
We will not require you to speak with a representative or complete a retention flow to cancel. Cancellations in the portal take effect on the on-screen confirmation. You will receive a cancellation confirmation by email. No further recurring charges will be processed and no further shipments will be sent after the current billing cycle ends. Orders already charged are handled under the Refund Policy.
13.5 Failed payments. If a recurring charge fails, you authorize us to retry the charge, to contact you for updated payment details and to pause shipments until payment is received. Your continued enrollment reaffirms your authorization to charge your payment method.
13.6 California subscribers. If you are a California resident, the following applies under California Business and Professions Code Section 17600 et seq.: your subscription renews automatically at the interval you selected at the then-current price unless you cancel before the next renewal date; you may cancel at any time at subscriptions.mp-ma.com or by emailing hello@mp-ma.com, and we will not make it difficult to cancel; if we fail to provide the required disclosures before your enrollment, we will refund any charges you did not authorize on request to that email address. You may also contact the California Department of Consumer Affairs, Consumer Information Division, 1625 N. Market Blvd., Suite N 112, Sacramento, CA 95834, (800) 952-5210.
14. SMS and Mobile Messaging
If you opt in to text messages, you consent to receive recurring automated marketing and transactional text messages from or on behalf of MP-MA at the mobile number you provided. Consent is not a condition of purchase. Message frequency varies; message and data rates may apply. Reply STOP to any message to opt out, or HELP for help. Carriers are not liable for delayed or undelivered messages.
15. Reviews, Testimonials and Submissions
By submitting reviews, testimonials, photos, comments or other content ("User Content"), you grant MP-MA a perpetual, worldwide, royalty-free, transferable, sublicensable license to use, reproduce, modify, distribute, publicly display and create derivative works from that content for business and marketing purposes. You represent that you own or control all rights in the User Content, that it is truthful and reflects your genuine experience, and that it does not violate third-party rights. We may remove or decline to post User Content at our discretion. We may cooperate with law enforcement or a court order directing us to disclose user information, and you hold us harmless for disclosures made in good-faith compliance with legal obligations.
16. Disclaimer of Warranties
THE WEBSITE, PRODUCTS AND ALL CONTENT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY OR OTHERWISE, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, TITLE, ACCURACY, RELIABILITY AND AVAILABILITY. WE DO NOT WARRANT THAT THE WEBSITE WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT PRODUCTS WILL MEET YOUR EXPECTATIONS. OUR 90-DAY MONEY-BACK GUARANTEE IN THE REFUND POLICY IS YOUR REMEDY IF YOU ARE NOT SATISFIED WITH A PRODUCT.
17. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL MP-MA OR ITS OWNERS, AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AGENTS OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, PUNITIVE OR MULTIPLE DAMAGES, INCLUDING LOSS OF PROFITS, LOSS OF DATA, LOSS OF GOODWILL OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATING TO THESE TERMS, YOUR USE OF OR INABILITY TO USE THE WEBSITE, ANY PRODUCT PURCHASE, ANY SUBSCRIPTION, OR ANY ADVERTISING OR MARKETING PRACTICES, REGARDLESS OF THE THEORY OF LIABILITY, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHERWISE.
17.1 Cap on direct damages. TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID TO US DURING THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100.00). THIS IS YOUR SOLE AND EXCLUSIVE REMEDY.
17.2 Allocation of risk. You acknowledge that the pricing of the Products reflects this allocation of risk and that we would not enter into these Terms without these limitations. Some jurisdictions do not allow certain limitations; in that case the limitations apply to the fullest extent permitted.
18. Indemnification
You agree to defend, indemnify and hold harmless MP-MA and its owners, affiliates, licensors, service providers, officers, directors, employees, contractors, agents and successors from and against any claims, damages, liabilities, losses, costs and expenses (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms, your misuse of the Website or Products, your violation of any law, or your violation of any third-party rights. We may assume the exclusive defense and control of any matter subject to indemnification.
19. Time Limit on Claims
TO THE FULLEST EXTENT PERMITTED BY LAW, ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS, THE WEBSITE, ANY PRODUCT OR ANY SUBSCRIPTION MUST BE COMMENCED WITHIN ONE (1) YEAR AFTER THE CLAIM ACCRUES. IF NOT COMMENCED WITHIN THAT PERIOD, THE CLAIM IS PERMANENTLY BARRED.
20. Dispute Resolution and Binding Arbitration
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT. EXCEPT AS EXPRESSLY PROVIDED BELOW, YOU AND MP-MA AGREE TO RESOLVE ALL DISPUTES EXCLUSIVELY THROUGH FINAL AND BINDING INDIVIDUAL ARBITRATION.
20.1 Agreement to arbitrate. Any dispute, claim or controversy arising out of or relating to these Terms, the Website, any Product, any subscription or automatic renewal, any advertising or marketing practice, or any alleged misrepresentation (a "Dispute") shall be resolved exclusively through binding, confidential arbitration on an individual basis. "Dispute" is to be interpreted broadly.
20.2 Federal Arbitration Act. These Terms evidence a transaction in interstate commerce. The Federal Arbitration Act (9 U.S.C. § 1 et seq.) governs the interpretation and enforcement of this arbitration agreement. The arbitrator decides all threshold issues of arbitrability, including scope, validity and enforceability.
20.3 Pre-arbitration notice. Before starting arbitration, the initiating party must send a written Notice of Dispute. Notice to us must be sent by email to hello@mp-ma.com with the subject line "Notice of Dispute" and must include your full name, mailing address, the email address used for your order, a description of the claim and the specific relief sought. Notice to you will be sent to the email address on your order. The parties will try in good faith to resolve the Dispute for thirty (30) days after the notice before either party may file for arbitration.
20.4 Self-help remedies. Nothing in this Section prevents us from responding to chargebacks, pursuing collection of amounts owed, suspending or terminating accounts, offsetting amounts owed, or enforcing payment obligations as permitted by law.
20.5 Procedure. Arbitration will be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules before a single neutral arbitrator. If the AAA is unavailable, the parties will select another nationally recognized arbitration provider, or a court will appoint one. The arbitrator may award any individual remedy available under applicable law, including damages, declaratory and injunctive relief and attorneys' fees where authorized by statute or contract, but may not award relief on a class, representative or consolidated basis. Hearings, if any, may be held by video conference.
20.6 Costs. Filing, administration and arbitrator fees are governed by the AAA Consumer Arbitration Rules. To the extent those rules require, we will pay arbitration fees that exceed what you would pay to file a comparable action in court. Each party bears its own attorneys' fees unless the law provides otherwise.
20.7 Small claims. Either party may bring an individual action in small claims court instead of arbitration.
20.8 Equitable relief. We may seek temporary, preliminary or permanent injunctive or equitable relief in a court of competent jurisdiction for claims involving intellectual property, confidential information, unauthorized resale, fraud or misuse of the Website that threatens irreparable harm.
20.9 Public injunctive relief. To the extent applicable law prohibits waiving a claim for public injunctive relief, that claim may be brought in court. All other claims remain subject to arbitration.
21. Class Action Waiver
YOU AND MP-MA AGREE THAT ALL DISPUTES SHALL BE BROUGHT ONLY IN AN INDIVIDUAL CAPACITY. YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION, SERVE AS A CLASS REPRESENTATIVE, ACT AS A PRIVATE ATTORNEY GENERAL, OR JOIN OR CONSOLIDATE CLAIMS. THE ARBITRATOR HAS NO AUTHORITY TO CONDUCT CLASS PROCEEDINGS.
22. Mass Action Waiver
No Dispute may be brought as a "Mass Action", meaning twenty-five (25) or more similar arbitration demands filed within one hundred eighty (180) days and coordinated by the same or affiliated counsel. If that occurs, claims will be grouped in batches of no more than two hundred (200) claimants, only one batch will proceed at a time, a separate arbitrator will be appointed per batch, and statutes of limitation are tolled during the batching period. A neutral special master may be appointed to resolve procedural disputes about batching.
23. Opt-Out Right
You may opt out of the arbitration agreement within thirty (30) days after you first accept these Terms by emailing hello@mp-ma.com with the subject line "Arbitration Opt-Out". Include your name, mailing address, the email address used for your order and a clear statement that you wish to opt out of arbitration. Opting out does not affect your other rights or obligations under these Terms.
24. Jury Trial Waiver and Claim-Specific Severability
IF ANY DISPUTE PROCEEDS IN COURT, YOU AND MP-MA WAIVE THE RIGHT TO A JURY TRIAL TO THE FULLEST EXTENT PERMITTED BY LAW. If any part of the arbitration agreement is found unenforceable as to a specific claim, that claim will proceed in court while all other claims remain subject to arbitration.
25. Governing Law
Except as provided in Section 20, these Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict-of-law principles.
26. Force Majeure
We are not liable for any delay or failure to perform caused by events beyond our reasonable control, including natural disasters, public health emergencies, labor disputes, supply chain disruptions, governmental actions, war or terrorism, internet or hosting failures, payment processor outages, or carrier delays. Performance is excused for the duration of such an event.
27. Third-Party Websites and Links
The Website may link to third-party websites and services. We are not responsible for their content, practices, accuracy or legality. Use them at your own risk and review their terms and privacy policies.
28. Copyright Complaints (DMCA)
If you believe content on the Website infringes your copyright, email hello@mp-ma.com with: identification of the copyrighted work; identification and location of the allegedly infringing material; your contact information; a statement of good-faith belief that the use is not authorized; and a statement, under penalty of perjury, that the information is accurate and that you are the owner or authorized to act for the owner.
29. Assignment
You may not assign your rights or delegate your obligations under these Terms without our prior written consent. We may assign or transfer these Terms, in whole or in part, without restriction, including in connection with a merger, acquisition, reorganization, sale of assets or by operation of law.
30. No Waiver; Severability
Our failure to enforce any right or provision of these Terms is not a waiver of future enforcement. A waiver is effective only if in writing. If any provision of these Terms is invalid, illegal or unenforceable, it will be severed and the remaining provisions remain in full force.
31. Termination
These Terms remain in effect until terminated. We may terminate or suspend your access at any time for violations. Provisions regarding intellectual property, disclaimers, limitation of liability, indemnification, dispute resolution, time limits on claims and payment obligations survive termination.
32. Entire Agreement
These Terms, together with our Privacy Policy, Refund Policy and Shipping Policy, constitute the entire agreement between you and MP-MA regarding your use of the Website and purchase of Products and supersede any prior agreements. No ambiguity shall be construed against the drafting party.
33. Contact
Questions about these Terms, notices of dispute and arbitration opt-outs should be sent to hello@mp-ma.com.
